Conflicts over how marital property should be allocated can cause outsized problems for divorcing spouses. If spouses cannot reach an agreement on how their assets and debts should be divided, Florida law requires courts to make a determination based on the principle of equitable distribution. This does not necessarily mean that the shares will be equal but that a judge renders a decision based on what he or she believes to be fair.
